Moussa says immunization of election commission’s decisions does not violate constitution

Amr Moussa, head of the 50-member committee that was tasked with amending 2012 constitution, said we absolutely should stop at the word of ‘immunization’ of the High Elections Commission’s decisions and that he would have used another wording for it, unless the Supreme Constitutional Court had decreed constitutionality of the immunization.

In a talk show aired on the privately-owned TV channel Al-Kahera wal Nas on Saturday, Moussa said that he expressed his point of view on a legal memorandum by the Interim President Adly Mansour and that he requested viewpoint of the court, which convened on 4 March and decided that immunization does not violate the constitution.
Moussa added that the immunization does not violate constitution saying that although article no. 97 banned the immunization of any decision by judiciary, the article no.228 of the interim articles chapter stipulates that the election commission; its formation, specialities and nature of decisions remain in force.                                        
Moussa said that we should consider views of specialized people to exceed the ongoing phase adding that the immunization is based on a constitutional view and a political stance to avoid disturbance.
Politicians reject the immunization of the commission’s decisions for fear of facilitating election fraud.
