Court rejects former prosecutor general’s appeal against dismissal

The Court of Cassation on Tuesday rejected the appeal filed by former prosecutor general Abdel Maguid Mahmoud to overturn the presidential decree that removed him from his position.

In his 21 Nov 2012 decree, President Mohamed Morsi appointed a new prosecutor general, Talaat Abdallah, and announced that the position would henceforth be appointed by the president every four year term.
 
The Cairo Court of Appeal on Tuesday set a court date of 21 July to rule on Mahmoud’s request for a report about the court’s previous 27 March rulings concerning his post.
 
The appeals court had ruled on 27 March to invalidate Abdullah’s appointment by President Morsi. The judge, however, did not specify how the verdict should be carried out, nor if should be carried out immediately, or after a court of second instance ruled on an appeal.
 
Judge Thanaa Khalil recused himself on Tuesday from ruling on Mahmoud’s appeal, reported state run Al-Ahram.
