The presidency discusses Monday the proposals regarding the presidential elections law submitted by political parties and protecting the decisions of the Supreme Electoral Commission of being overturned or changed by the president.
Some jurists and politicians have different opinions about the sovereignty of the Supreme Electoral Commission.
Secretary general of the Arab Lawyers Union Saber Amar said on Monday that placing the Supreme Electoral Commission out of presidential authority has advantages. It purifies the electoral process from appeals and contributes to the stability of the presidential position, he added.
Amar told Youm7 that legally and in the framework of the constitution any act of judicial work cannot be immune, but that this issue could be solved in several ways.
He pointed out that the Supreme Constitutional Court is a judicial commission and it is possible to appeal on the electoral process, adding that the possible of vexatious appeals in the presidential elections may disappear through this step.
Lawyer Bahaa el-Din Abu Shaka, said Monday that the sovereignty of the Supreme Electoral Commission opposes the agreed constitutional principles which stated that any work or decision may not be immune, whether its source is from the judicial control or not.
Abu Shaka told Youm7 that placing the elections commission out of presidential authority is incompatible with the principles of separation between the authorities. He added that the alternative is to allow appeals on the electoral process during a period that does not exceed 10 days.
Secretary general of Egyptian Democratic Party Ahmed Fawzy said on Monday it is surprising that the presidency does not take into account all proposals of the parties and political forces, as he does not know the reason for this.
Fawzy said that although January 25 Revolution changed the track but unfortunately the presidency does not take the proposals into account.
He told Youm7 that the sovereignty of the Supreme Electoral Commission has positive and negative aspects, as for example some advanced and ancient democracies may have immune commission decisions and an immune presidential position, while others have the possibility of appeal under certain conditions.
Fawzy pointed out that it is better to determine a department that allows the appeal on the decisions before the Supreme Administrative Court in a certain period that does not exceed one week only.
He said that his party did not send proposals to the presidency regarding the presidential elections law.
Spokesperson of the Administrative Prosecution Authority Abdel Nasser Khatab said on Monday that the authority is conducting databases of the members of the Administrative Prosecution and the employees who will supervise the next presidential elections.
Khatab told Youm7 that the number of employees of the prosecution authority who will supervise the elections is more than 3000. He added that the “apology applications” of those who did not supervise earlier elections would be considered and after completing the list, they will be provided to the Supreme Electoral Commission.
