An Egyptian court referred Adel Habara and six others to the Grand Mufti on Tuesday to review their death sentence after being convicted in the killing of 25 soldiers Rafah in August last year.
Militants ambushed a bus in Sinai and shot dead 25 Central Security recruits after they forced them to leave their transportation.
Referral of files to the Mufti is a procedural step taken to decide whether or not a defendant may be sentenced to death.
The court will issue its verdict on December 6 in a hearing session.
The prosecution accused the defendants of committing terrorist acts and collaborating with al-Qaada.
